These Terms of Service ("Terms") govern your access to and use of Deepmock ("we", "us", or "our"), including the website at deepmock.io and all associated services (collectively, the "Service"). Please read these Terms carefully before using the Service.

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms are governed by the laws of Victoria, Australia.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Service.

2. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account.

We offer account creation via Single Sign-On (SSO) through third-party providers. When using SSO, you authorise us to access profile information from your SSO provider as permitted by your privacy settings with that provider.

You are responsible for keeping your login credentials confidential. You must notify us immediately at support@deepmock.io if you suspect any unauthorised access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your credentials.

2.1 One Account Per Person

Each account is for use by a single individual only. You may not share your account credentials with any other person, allow others to access the Service using your account, or use another person's account. We monitor usage patterns to detect and prevent account sharing. Accounts found to be shared may be suspended or terminated without refund.

3. Licence to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial interview preparation purposes.

This licence does not permit you to:

  • Copy, modify, distribute, sell, or sublicence any part of the Service or its underlying software
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service
  • Use the Service for any commercial purpose, including offering coaching or preparation services to third parties using our platform
  • Remove, obscure, or alter any intellectual property notices or labels on the Service
  • Use automated tools, bots, scrapers, or scripts to access or interact with the Service

All rights not expressly granted in these Terms are reserved by Deepmock.

4. User Content

4.1 Your Content

The Service allows you to upload, record, store, and share content including video recordings, text responses, and other materials ("User Content"). You retain ownership of your User Content.

4.2 Licence You Grant Us

By uploading or creating User Content, you grant Deepmock a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely for the purpose of providing the Service to you. This includes processing your video recordings through AWS services for analysis and feedback.

4.3 Peer Review

If you choose to share a recording for peer review, that recording will be accessible to the other individuals you have shared it with. You are responsible for ensuring you are comfortable sharing content before doing so. You may withdraw shared recordings at any time from your account settings.

4.4 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

  • You have all necessary rights to upload and share the content
  • Your content does not violate any applicable law or third-party rights
  • Your content does not contain material that is defamatory, discriminatory, harassing, or otherwise harmful

We reserve the right to remove User Content that violates these Terms, without notice.

5. AI Analysis and Facial Recognition

The Service uses artificial intelligence, including AWS Rekognition, to analyse your video recordings and provide feedback on facial expressions, emotional presentation, and interview delivery. This constitutes automated processing of special category data.

You will be asked for explicit, separate consent before this processing begins. You may withdraw your consent at any time by contacting support@deepmock.io.

Important: The AI-generated feedback provided by Deepmock is for interview preparation purposes only. It does not constitute professional advice, a guarantee of interview success, or any assessment of your suitability for a medical career. We make no representation that following our feedback will result in any particular outcome.

6. Subscriptions and Payment

6.1 Subscription Plans

We offer free and paid tiers. Details of current plans, features, and pricing are available at deepmock.io/pricing. We reserve the right to change pricing with reasonable notice.

6.2 Currency

All prices are in Australian Dollars (AUD) unless otherwise stated.

6.4 Refunds

Subject to your rights under Australian Consumer Law and applicable UK and EU consumer protection law, fees are generally non-refundable once a plan has commenced. However:

  • If the Service is materially defective or not fit for the purpose described, you may be entitled to a remedy under Australian Consumer Law, UK consumer rights legislation, or EU consumer rights directives.
  • If we terminate your account for reasons other than your breach of these Terms, we will provide a pro-rata refund for the unused portion of your subscription.

Refund requests should be directed to support@deepmock.io. We will assess each request on its merits.

6.5 Free Tier Limitations

Free tier accounts are subject to usage limits as described on our website.

7. Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or in a way that violates any applicable local, national, or international law or regulation
  • To infringe the intellectual property rights of Deepmock or any third party
  • To upload or transmit viruses, malware, or any other malicious code
  • To harass, abuse, threaten, defame, or discriminate against any person
  • To submit false, misleading, or fraudulent information
  • To impersonate another person or entity
  • To attempt to gain unauthorised access to any part of the Service or its infrastructure
  • To scrape, harvest, or systematically extract data from the Service
  • To use the Service in a way that could damage, disable, or impair it
  • To share your account credentials or otherwise enable another person to access the Service using your account

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, and all other content created by Deepmock, is owned by or licensed to us and is protected by Australian and international intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.

The Deepmock name and brand are proprietary to us. You may not use our name, logo, or branding without our prior written consent.

Third-party trademarks referenced on the Service remain the property of their respective owners.

9. Third-Party Services

The Service relies on third-party services including AWS (for storage and AI processing) and payment processors. Your use of the Service is also subject to the terms and privacy policies of these third parties where applicable.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Any AI-generated feedback will be accurate, complete, or suitable for your specific circumstances
  • Use of the Service will result in interview success or any particular outcome

Nothing in these Terms excludes any guarantee or right you have under Australian Consumer Law, UK consumer rights legislation, or EU consumer law that cannot lawfully be excluded.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Deepmock and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the total amount you have paid us in the 12 months preceding the event giving rise to the claim.

12. Termination

12.1 Termination by You

You may close your account at any time by contacting support@deepmock.io. Upon closure, your data will be deleted in accordance with our Privacy Policy, subject to any legal retention obligations.

12.2 Termination by Us

We may suspend or terminate your account and access to the Service immediately if:

  • You breach any material provision of these Terms
  • We are required to do so by law
  • We determine that continued access poses a risk to the Service, other users, or third parties

Where we terminate your account for reasons other than your breach, we will provide reasonable notice where practicable and will refund any prepaid fees for the unused portion of your subscription on a pro-rata basis.

12.3 Effect of Termination

Upon termination, your licence to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.

14. Dispute Resolution

If you have a complaint or dispute, please contact us first at support@deepmock.io. We will endeavour to resolve disputes informally within 30 days.

If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the courts of Victoria, Australia.

Nothing in these Terms prevents you from lodging a complaint with a relevant consumer protection authority.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, available at deepmock.io/privacy. By using the Service, you acknowledge that you have read and understood our Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy regarding the handling of personal data, the Privacy Policy prevails.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deepmock regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations, including in connection with a merger, acquisition, or sale of assets, with reasonable notice to you.
